1. Introduction
Welcome to CivicResourceNexus ("we," "us," or "our"). The ensuing Terms & Conditions ("Terms") dictate your engagement with our yacht charter outfits and the online platform located at civicresourcenexus.sbs (collectively, "the Service") managed by CivicResourceNexus.
By securing a charter or using our Service, you consent to these Terms. Should you object to any section of these terms, you are not permitted to use the Service.
2. Service Overview
CivicResourceNexus offers an array of yacht charter services, which include:
- Chartering yachts on a daily basis
- Evening sailing escapades
- Business getaways
- Exclusive celebrations
- Extended sailing expeditions
Our offerings are contingent on availability and climatic conditions. We may revise or discontinue services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To make a reservation for a charter, you are required to:
- Have reached the age of majority, at least 18 years old
- Provide current and comprehensive details
- Settle the necessary down payment as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A reservation is deemed confirmed only after payment is processed and we send you written acknowledgment. We retain the discretion to deny service to any individual.
3.3 Availability
Scheduling of charters is reliant on both the availability of vessels and favorable meteorological conditions. We will strive to honor your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All price quotes are in € and encompass relevant taxes unless stated otherwise. Prices are liable to alteration without prior announcement.
4.2 Payment Schedule
- Deposit: Due at the time of booking, it's 50% of the entire cost of the charter
- Remaining Balance: Expected to be paid 48 hours before the scheduled departure of the charter
- Extra charges (where applicable): Due after the charter concludes
4.3 Payment Methods
We accept an array of payment methods, including well-known credit cards, direct bank transfer, and verified cheques. All payments are managed via protected, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Prior to 72 hours before departure: Full refund excluding processing charges
- From 24 to 72 hours before departure: Refund of 50%
- Within 24 hours of departure: Not eligible for a refund
5.2 Weather Cancellations
Should our captain decide that weather conditions are unsafe, we will propose to:
- Rebook your charter for another available date free of additional charges
- Process a full refund if rebooking isn't workable
5.3 Mechanical Issues
Should there be mechanical issues with the designated vessel, we will endeavor to supply an appropriate substitute. If substitution is not possible, we will return the full payment.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Heed all directions provided by the crew
- Utilize safety garments as instructed
- Disclose any health conditions that might influence their safety
- Stay within the assigned areas on the yacht
6.2 Prohibited Items
The following are not permitted aboard:
- Containers fashioned from glass
- Contraband substances
- Firearms or any weapons
- Excessive quantities of beverages (exceeding a moderate intake)
- Animals (unless approved in advance)
6.3 Conduct
Passengers are expected to behave respectfully at all times. A charter may be terminated prematurely with no refund if passenger behavior endangers safety or affects the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is limited to the cost paid for the charter. We are not accountable for:
- Injuries to persons due to their own negligence
- Theft or harm to personal belongings
- Indirect or punitive damages, or any that follow consequently
- Delays caused by the weather or external circumstances outside our influence
7.2 Insurance Coverage
We maintain an extensive marine insurance policy to cover our vessels and operations. Patrons are responsible for their travel and personal insurance coverage.
7.3 Assumption of Risk
By partaking in our charter offerings, you acknowledge the inherent dangers of marine activities and accept accountability for your safety and security.
8. Modifications and Itinerary Changes
We reserve the discretion to adjust itineraries, paths, or timetables due to weather-related or safety concerns, or operational necessities. We will make every effort to provide alternatives of similar value.
9. Force Majeure
We are not answerable for hold-ups, cancellations, or adjustments resulting from factors beyond our dominion, including, but not constricted to:
- Harsh meteorological phenomena
- Natural calamities
- Regulatory directives
- Port shutdowns
- Technical malfunctions
10. Privacy and Data Protection
The handling of your personal data is in line with our Privacy Policy. By utilizing our services, you sanction the collection and utilization of your information as outlined in our Privacy Policy.
11. Intellectual Property
All contents displayed on our website, such as text, visuals, trademarks, and photographs, are protected by intellectual property laws. Reproduction, circulation, or the forging of derivative works without our prior written approval is prohibited.
12. Governing Law
The applicable laws governing these Terms are those of Spain. Any resultant disputes shall be deliberated in courts situated within Barcelona, Spain.
13. Changes to Terms
We may renew these Terms as necessary. Such modifications will be signaled on our website with the inclusion of the revision date. Continual usage of our services connotes your compliance with the modified terms.
